also it seems to be caused by the clips of the mudflaps. is it illegal to have no mudflaps, was going to remove them. the back ones are smashed up anyway.

just make sure you dont leave the rust or it will eat your car lol

I'm abit confused as to how the clips of the mudflaps would be causing the paint to flake. What year is the car? Could be due to previous poor care of the car, but as antknee said, best bet is to strip it back, apply a rust treatment and then respray.
As always, pictures may help give a more detailed answer to the problem
