TBH if it was my car on there, and i wasn't around to pull the auction then i'd refuse to sell it as well.

It's not a legal binding contract on eBay Motors so I can't really see you winning this one imo...

Maybe offer what your willing to pay for it? I know you rightfully won it but lets say you offer £400, its nearly £400 he legally shouldn't get.

Its a toughy. Depends if you want the hassle or not

think ile be playing nasty as just read case saying this
This case has been opened by the seller with the following reason: I sold item to another buyer.
Additional information provided by the seller: the car was sold the earlier today, but as i could not remove it or amend the description as there
was less that 12 hours left i could not let the buyer no. i tryed adding a note but he obviously didnt
see it.
first off phoned him 2 hours before end so had my number could have called 2 no such note on listing even ebay can see that

You are the righfull owner off tht car, you can say yo ebay u foned him and discused buying the car whole and you have a record off the call, any bidding forum or website is legit under law. People round here sell there cars for a pint as long as someone will do a auction so to speaj. It is the sellers fault. He also dosent state that if u bid you wont get the whole car

Hmmm you dont have a leg to stand on really. But i'd still pursue it just to p*ss him off tbh. Can you leave him bad feedback!

Its rubbish as he has been a kn*b but nothing that you can really do.

this is ridiculous, imagine that to be your car. you would be like 'oh thats fine you won it fair and square'?

also, it got no bids because its advertised as a parts listing,

and weve already realised that he hasnt got a leg to stand on with ebay bid policy

why is this discussion ongoing?

I wouldn't bother, you've not lost anything except perhaps a bargain which probably would never have happened.

Don't stress yourself out chasing it mate.

Come on seriously?

If it wasn't such a s**t advert and was a PROPER car sale then yes you may have an argument but what are you going to say to ebay? The advert is crap it could be selling a bolt or the whole car like others have said. The phone call also doesn't count he has as much right to make up a bulls**t story saying he sold the car as you have to say you phoned him nothing can be proven so both will be void.

Sorry, you haven't got a leg to stand on.

The most that'll happen is seller will get a strike against his name, neg feedback, and will drop is seller rating to below average. Unlikely to get any form of serious punishment because of the poor quality of listing.

What a pointless thread, Ebay policy has more holes than a sieve.

The whole "he is obliged legally" is a joke, surely no-one here really believes that? Oh, wait....

Jesus I don't know what's more disappointing, that I just wasted 3 minutes of my life reading this or one minute typing a reply.
