If it wasn't such a s**t advert and was a PROPER car sale then yes you may have an argument but what are you going to say to ebay? The advert is crap it could be selling a bolt or the whole car like others have said. The phone call also doesn't count he has as much right to make up a bulls**t story saying he sold the car as you have to say you phoned him nothing can be proven so both will be void.
