My 206 has been stolen, it was recovered by the police and has been in an accident. My insurance company have written it off but are refusing to payout as there was no damage to my car's locks or ignition. They are saying that someone must have had access to my car keys. My car was locked and I am the only person with the car keys....how did somone steal and drive my car without the keys and without causing any damage....can anyone help me please?

Very easily. If you know what you are doing, you could get a key to match your locks in about 3 minutes.

Shaved key can do that,would be indentical to your key so there will be no damage etc x

Basically a shaved down key that will fit in his ignition and start the car etc x

All you need is a tickler for the lock, and then just program a chip for the immo. 45 seconds, tops.

But saying that, I could get a key and program it and just walk straight up and start the car and undo the central locking lol

It's a 206 SE HDI, year 2005. Thanks for all your replys but how can I prove to the insurance company how it could have happened?

See if your car starts the engine.

If it does, then the previous owner kept a key or you had the car nicked

If it doesn't, someone coded a new key to the car.

And run diag to see if ECU is matched

I haven't seen my car since before it was stolen, the police recovered it for forensics then my insurance company picked it up, I no long have any keys as the insurance company now have them...I had both at the time it was stolen.

Feel for you mate Ive never had to experience anything like that before but my dads cozzy got pinched when I was v.young and when it got recovered he said it didn't feel the same car so he sold it.

Thanks...I've cried, been sick and now I'm angry...I love my little car and I've worked hard for it and I want it back but feel that I have no say in what happens to it...it's not fair.

Oh and to the person who refered to me as 'he'...I'm a 'she' lol x

As if they can refuse to pay out even though you sent them both keys? Do they actually think it is impossible to rob a car without the keys?

Sounds like this is one of those typical 'finding any reason' to try and refuse pay out

is there any legal advice you can get?

did you ever report to the police and insurance that your car has been stolen before the accident happen?

That is sickening and I sincerely and whole-heartedly wish they suffer permanent bodily damage soon..

Hope you get a good outcome with the insurers, don't let them give you any crap.

I would ask the insurance what they are playing at.

They have basically stolen your property. If they have no intention of paying out on the claim, then you still own the car and they are committing theft by holding onto the car and if they dispose of it, then you will have a good case against them. Until they pay out for the vehicle, it is still yours (or the finance companies)
Ring them up and tell them you want to make a claim for theft and then tell them that they have stolen it from you. See how long it takes them to sort something out. I'm guessing you didn't send the counterpart of the V5 or the MOT cert to them?

Seabook - I've spoken to a solicitor who say I have to follow their complaint proceedure first, I've also lodged a complaint with the financial ombudsman and it was the police who told me it had be stolen...3 youths were seen running away from it after they had taken a corner too fast and hit the kurb...I thought it was still parked outside my house!

V9977 - thanks very much for your support I hope so too.

mecca1411 - there's no finance on the car, it's mine and the insurance have all my documents they said I had to send them in before they would consider any claim....did take photocopies though!

The complaint to the ombudsmen will fall through as you haven't waited 6 weeks for a reply from the insurance.

Infact it's 8 weeks not 6, was a typo as I was on the phone.

The Ombudsman won't investigate your claim now.

I spoke to the ombudsman yesterday Lee, they have given me a case reference number and have said they will contact the underwriters...I can't believe I'm having to do all this, I've got nearly 20 years no claims and a my licence is and always has been clean which is more years than I care to admit to, I don't think any of that counts for anything now!

I bought the policy through hastings direct, the underwriters are advantage.

Thats very odd! In my trade I see all sorts of RTC's and damaged cars and i dont remember any insurance company ever asking for original documents during the process of a claim. Photocopies for solicitors, yes. But not originals.

Very sorry to hear about this mate
I'm also insured through Hastings/underwritten by advantage and when i had my claim on my car at no point did they ask for any documents, apart from v5's etc when the vehicle was deemed a write off.
As one post said above, don't take any BS. It took them 3 weeks to even look at my car after my accident when they promised an engineer out the next day.
Considering we pay them a fair bit they don't half look for any excuse to do anything but their job.

Don't we have a member on here that works in an insurance claims department? Think it was Dopey and I'm sure they once mentioned they worked for Hastings. Not seen them on for a while, but you could always try a PM and see if you get a reply.
