Hello
I have a tear in my drivers seat which is caused by stress on a seam just by sitting in the chair normally.
Would this be a claim under warranty?? I would argue that for a car with 12k miles you would not expect this to happen under stress. i have attached a photo.
I have contacted my dealership (used cars) but they haven't yet responded.

It is literally 'wear & tear' so, no they won't cover it.

ive only had the car 2 days, it was done by the previous owner but i didnt notice it until i bought the car!
the warranty excludes wear and tear but i'm sure it states this is subject to the mileage etc
Also i think fundamentally there is an issue with the chair because if I get it repaired I think it will happen again

You can try.
But I highly doubt they will do anything about it.

By all means try! Don't give in if you believe it's a warranty issue. You may get lucky or have a generous customer service advisor talking to you!
Be sure to exacerbate the low mileage and everything.
If it doesn't work then get it repaired by an upholsterer or something. They will repair and probably reinforce.

It also may not be covered as you're not the original purchaser of the car. Second owners can be on a restricted warranty for some items. Still worth a try though.

He would of got a warranty when he purchased the car anyway. Thet normally give 6 months.
I dont think they will replace it for you but you may be able to barter with them and ask if they would help out with the repair cost.

myth - "Second owners can be on a restricted warranty for some items"
warranty brochure clearly says new owners have the same rights

I reckon it'll be a wear and tear issue - at the end of the day it all depends on how the car was used or how careful the previous owner was. Both of which will be difficuly to prove, as would premature failure of the materials.
