This might seem like a stupid question but should the strut top bearing be visible with the car jacked up??

Had the car jacked up to change the drop link and when i had a look at the strut top from the inside i could see some of the strut top bearing...

Shouldn't be able to see any bearing because the top mount holds it tight in the turret.
2001 GTi 138, Bilstein Sprint dampers, H&R springs, 21mm Peugeot Sport torsion bars, 22mm rear ARB, Peugeot Sport Group A wishbones, 283mm discs, Goodridge stainless hoses, Maniflow 304 grade 4-2-1 2.5" manifold and system, 200 cell cat, Richard Longman head, 45mm Jenvey throttle bodies, 9.5mm TB spacers, 90mm air horns, Jenvey throttle linkage, Jenvey fuel rail, Aeromotive and Goodridge fuel fittings and braided hose, ITG sausage filter, Radtec custom radiator, Piper Ultimate Road cams, Piper vernier pulleys, Omex 600 ECU. Saxo electric PAS pump, Vibra Technics engine mounts. Samco coolant hoses, TTV steel flywheel, 4.76 final drive ratio, 307 CC 180 ratios. 2019 BMW 530i. 2017 Mercedes C300 convertible.

Should be like this. The spring tension should hold the bearing against the top mount.

i can see the bearing where thru the hole in the part the spring sits against as if its out of line

You got lowered springs? Sounds like the springs aren't the right overall length for the strut and thus move out of line when not on the deck...

Jasoon - jack the car up again and see if you can move the spring pan while she's in the air. If you can and they are standard springs, your have problems!

Well got the problem sorted ended up replacing that top mount and the bottom arm....
